Hi there, Michelle here...
Sorry to hear about your friends accident. Sounds like he is in a lot of pain. There are lots of things you need to know,so I will do my best to make this easy for your friend.
First, your friend does not need health insurance in order to seek treatment for injuries from the car accident. Instead, his injuries will be paid for through the at fault drivers car insurance. Your friend needs to call the insurance company for the at fault driver and tell them he is injured.
Secondly, your friend can call his own insurance and find out whether or not he might have PIP insurance. If he has PIP insurance on his own car insurance, regardless of fault in the accident, his insurance will cover his medical coverage. If he was not at fault, opening a claim with his own insurance will not raise his rates.
Third, he does not need proof from a hospital specifically, but he must see a doctor. He does need to see a medical doctor who will be able to diagnosis what his injuries are. It is very important that your friend sees someone, if not a medical doctor, then he should see a chiropactor who will be able to do x-rays and help him get out of pain.
There is nothing medical for the at fault driver to pay for if your friend has not had any medical treatment or care. The at fault driver will not just make a payment for no reason.
If you are wanting the at fault driver to make a compensation payment to your friend, the way you would do this is through the insurance company for that driver. The driver of the car that hit your friend has no reason to just give your friend money.
You do not specify why your friend is going to court. If it is small claims court then possibly a settlement will be worked out there. But as your friend has no medical expenses, it will be hard to prove he is injured.
Your friend may be going to court to simply deal with a citation from the accident. If this is the case, then your friend needs to make sure he is not found at fault, otherwise there will likely be no settlement at all, and his medical care then would only be covered by PIP if he has it.
I would highly highly recommend you seek help from a lawyer. Your case has a lot of unknowns in it for me, and your friend actually sounds like he might have some risk if he is found at fault in the accident.
